What is a BOC-3 and why do I need it?
BOC-3 ("Designation of Agents for Service of Process") is a federal filing that assigns an agent in each state to receive legal documents on your behalf. It's required by the FMCSA for carriers, brokers, and freight forwarders seeking interstate operating authority. Without a BOC-3, you cannot legally operate across state lines.
Who is required to file a BOC-3?
Any motor carrier, broker, or freight forwarder applying for or maintaining federal operating authority from the FMCSA for interstate business must file a BOC-3.
Are there any additional fees besides the enrollment cost?
The annual service fee is $129 plus a one-time $39 enrollment fee. In addition, there is a $15 processing and handling fee for any Service of Process received in excess of 5 pages (except for the first Service of Process of the year, which is included at no extra charge).
